1. Agreement to these terms

These Terms of Service constitute a binding agreement between you and Craftlure Timber. They apply to every visitor, client and prospective client who uses our website or commissions design work from us. If you do not agree with any part of these terms, you should not use the website or engage our services. Where a separate written proposal or statement of work is signed for a specific project, that document and these terms are intended to be read together; in the event of a direct conflict, the signed proposal governs for that project.

2. The nature of our services

Craftlure Timber provides design, consultation and planning services only. Typical deliverables include concept direction, dimensioned drawings, three-dimensional models where appropriate, material and finish schedules, and written guidance for fabrication or restoration. We are a design studio, not a workshop. We do not build, assemble, finish, deliver or sell finished wooden objects, and nothing on this website should be read as an offer to sell goods.

Because the physical realisation of any concept is carried out by you or by a third-party maker of your choosing, the quality, safety and durability of the finished article depend on factors outside our control, including the skill of the fabricator, the materials sourced and the conditions of use.

3. Eligibility

You must be at least eighteen years of age and capable of forming a legally binding contract to engage our services. By commissioning work, you confirm that the information you provide is accurate and that you have the authority to enter into this agreement, whether on your own behalf or on behalf of an organisation.

4. Scope of engagement and deliverables

The specific deliverables, milestones and fees for your project are defined in a written proposal or statement of work agreed before the engagement begins. Any work, format or service not expressly listed in that document is considered out of scope. Requests that fall outside the agreed scope may be accommodated as additional work and will be quoted separately.

Unless stated otherwise in writing, our deliverables are conceptual and documentary in nature. They are prepared to communicate design intent to a competent maker and are not a substitute for structural engineering, code compliance review or any professional certification that your jurisdiction may require for a given installation.

5. Quotes, fees and payment

Prices displayed on the website are starting points expressed in United States dollars and are provided for general guidance. The final fee for any engagement is confirmed in your proposal and reflects the scope, complexity and revision allowance of the project. Quotes are valid for thirty days from the date issued unless otherwise stated.

Unless agreed otherwise, an initial deposit is payable before design work commences, with the balance due at the milestones described in the proposal. Work may be paused where an invoice remains unpaid beyond its due date. All fees relate to professional design services and the time and expertise involved in producing them.

6. Client responsibilities

A successful design depends on timely and accurate input from you. You agree to provide the information, measurements, site access, references and approvals reasonably required for the work, and to respond to requests for feedback within a reasonable period. Delays in providing materials or decisions may extend timelines and, in some cases, affect fees.

You are responsible for verifying that any concept we provide is suitable for its intended location and use before it is built, including confirming dimensions on site and obtaining any permits or approvals required.

7. Revisions and timelines

Each proposal includes a defined number of revision rounds. Additional revisions beyond that allowance are available as further work and quoted accordingly. Estimated timelines are made in good faith based on the agreed scope and on prompt client cooperation; they are estimates rather than guarantees, and may be affected by the scale of the project, the number of revisions and external dependencies.

8. Third-party fabrication and restoration

Where you engage a carpenter, joiner, fabricator or other contractor to build or restore a piece from our documentation, that party acts independently of Craftlure Timber. We are happy to answer reasonable questions from your maker during the build, but we do not supervise, warrant or accept responsibility for their workmanship, materials, scheduling or pricing. Any contract for fabrication is solely between you and that party.

9. Intellectual property

Ownership and permitted use of the concepts, drawings and documentation we produce are addressed in our Intellectual Property Policy, which forms part of these terms. In summary, we retain rights in our underlying methods and in any concept until the agreed fees for the relevant project have been paid in full, at which point a licence to use the deliverables for the agreed purpose is granted as described in that policy.

10. Acceptable use of the website

You agree to use this website only for lawful purposes. You must not attempt to gain unauthorised access to any part of the site, interfere with its operation, misuse contact forms, or copy, reproduce or republish its content without permission. We may suspend or restrict access where we reasonably believe these terms have been breached.

11. Disclaimers and limitation of liability

Our services and website are provided on a professional but good-faith basis. To the fullest extent permitted by law, Craftlure Timber is not liable for indirect, incidental or consequential losses, or for any loss arising from the fabrication, installation, use or restoration of any item built from our concepts by you or a third party. Our total aggregate liability in connection with any engagement shall not exceed the fees actually paid to us for that engagement.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Indemnification

You agree to indemnify and hold harmless Craftlure Timber and its team against claims, damages and reasonable expenses arising from your misuse of our deliverables, from your breach of these terms, or from the construction, installation or use of any item produced from our concepts by you or a contractor engaged by you.

13. Governing law

These terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law principles. The courts located in Louisville, Kentucky shall have jurisdiction over any dispute arising from these terms or our services, subject to any rights you may have under applicable consumer law.

14. Changes to these terms

We may update these terms from time to time to reflect changes in our services or legal requirements. The current version is always published on this page with its revision date. Continued use of the website or our services after an update constitutes acceptance of the revised terms.
